Nutriwizard - Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Nutriwizard (“Company,” “we,” “our,” or “us”). By accessing, browsing, or using our website, mobile applications, AI-generated content, recipes, or any related services (collectively, the “Service”), you affirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to all of these Terms, you must immediately discontinue use of the Service.

1. Nature of the Service and No Professional Advice

Nutriwizard is an artificial intelligence (“AI”)-powered platform that generates recipes and related information. All content provided is for informational purposes only.

We do not provide:

Professional culinary advice
Nutritional or dietary advice
Food safety or allergen guidance
Medical advice or diagnosis

The Service is not a substitute for professional consultation with a qualified chef, dietitian, nutritionist, or licensed medical professional.

2. AI-Generated Content and Accuracy Disclaimer

All recipes, ingredient lists, nutritional information, allergen data, cooking instructions, and related materials are AI-generated and may be inaccurate, incomplete, unsafe, misleading, or unsuitable for certain individuals.

We expressly disclaim any responsibility for:

Errors, omissions, or inaccuracies in content
Unsafe or incompatible ingredient combinations
Foodborne illnesses, allergic reactions, or adverse health outcomes
Misinterpretation or misuse of the content
Kitchen hazards (e.g., burns, cuts, fires, smoke damage, appliance misuse)
Food safety failures (including undercooking, cross-contamination, improper storage, or temperature control)

You assume full responsibility for verifying the accuracy, safety, and suitability of any content prior to use.

3. User Responsibilities

By using the Service, you agree to:

Independently verify all recipe details before preparation or consumption
Follow proper food handling, preparation, and cooking practices
Check ingredient lists for allergens and dietary restrictions applicable to you or others consuming the food
Comply with all applicable laws, rules, and regulations in your jurisdiction
Use the Service only for lawful purposes and in accordance with these Terms

3A. Eligibility and Children’s Privacy (COPPA Compliance)

The Service is not directed to children under the age of 13.
By accessing or using the Service, you represent and warrant that you are at least 13 years old.
We do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected such information, we will delete it promptly.
If you are a parent or guardian and believe that your child under 13 has provided personal information to us, please contact us at legal@nutriwizard.net so we can take appropriate action.
Users between the ages of 13 and 18 may only use the Service with the involvement and consent of a parent or legal guardian.

4. Public Content & Social Sharing

When you create or post a recipe through the Service:

Your username will be publicly displayed alongside the recipe as its creator.
Recipes and usernames may be visible to other users, shared on social media, promoted by Nutriwizard, and indexed by search engines.
You grant Nutriwizard a perpetual, worldwide, royalty-free, non-exclusive license to display, share, distribute, promote, and otherwise use your recipe content (including your username as the creator) in connection with the Service.
You acknowledge and agree that once published, recipes and associated usernames may be copied, shared, or reposted by others beyond our control, and we are not responsible for such third-party actions.
You are solely responsible for ensuring that your posted content does not infringe the rights of any third party or violate any applicable law.

If you do not want your username publicly associated with a recipe, you must not publish it through the Service.

5. Use at Your Own Risk

The Service is used entirely at your own risk.
We make no warranties or guarantees of any kind regarding safety, suitability, or accuracy.

You expressly agree that Nutriwizard shall not be liable for any damages, harm, injury, or loss — including but not limited to allergic reactions, illness, injury, death, property damage, business interruption, or financial loss — arising from or related to the use of the Service.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

We disclaim all liability for indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation loss of profits, data, goodwill, health, or life.
Our total aggregate liability for any and all claims arising from or related to the Service shall not exceed fifty U.S. dollars (USD $50), regardless of the cause of action or theory of liability.
Some jurisdictions do not allow certain limitations of liability; in such cases, our liability shall be limited to the maximum extent permitted by law.

7. No Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise.
We specifically disclaim any warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, or non-infringement.

We do not warrant that:

The Service will be uninterrupted, timely, secure, or error-free
The results obtained from the Service will be accurate or reliable
Defects will be corrected
The Service or any associated servers are free of viruses or other harmful components

8. Indemnification

You agree to defend, indemnify, and hold harmless Nutriwizard, its owners, affiliates, officers, directors, employees, agents, and contractors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorneys’ fees) arising from:

Your use of or reliance on the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights or privacy rights
Any harm or injury caused to yourself or others in connection with the Service

9. Intellectual Property Rights

All content, branding, trademarks, trade names, and AI-generated recipes provided by the Service are the property of Nutriwizard or its licensors.

You may freely prepare and consume any recipes from the Service for personal use.

You may also share links to recipes from the Service or share screenshots of recipes on social networks for non-commercial purposes, provided you do not remove or alter attribution to Nutriwizard and the original creator’s username.

Any other use of our recipes or content — including but not limited to reproduction, redistribution outside permitted social sharing, public display, modification, inclusion in a database, training of artificial intelligence models, or incorporation into any product, service, website, application, or publication — is strictly prohibited without our prior written consent.

10. User Content

If you submit any content to Nutriwizard (including but not limited to recipe modifications, reviews, comments, or other materials), you grant us a non-exclusive, worldwide, royalty-free, irrevocable, perpetual license to use, reproduce, adapt, publish, translate, and distribute such content in any media in connection with the Service.

11. Modification of Terms

We reserve the right to update or modify these Terms at any time in our sole discretion.
We will post the updated Terms on our website and indicate the “Effective Date” above.
Your continued use of the Service constitutes acceptance of the modified Terms.

12. Governing Law and Jurisdiction

These Terms and any disputes arising out of or relating to them shall be governed by the laws of the State of Iowa, without regard to its conflict of law provisions.

You agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in Polk County, Iowa, for the resolution of any dispute.

13. Mandatory Arbitration and Class Action Waiver

To the fullest extent permitted by law:

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its rules.
Arbitration shall be conducted in Polk County, Iowa, before a single arbitrator.
You waive any right to participate in a class action or consolidated proceeding.

Notwithstanding the foregoing, Nutriwizard may seek injunctive or equitable relief in court to prevent unauthorized use or misuse of its intellectual property.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Nutriwizard concerning the Service and supersede all prior or contemporaneous agreements, communications, and understandings.
